GENESEO – The Honeyoye Falls man who was arrested by Geneseo Police on Nov. 15 for allegedly giving alcohol to a 15 year old girl is now facing rape charges for allegedly having sex with her that night.
According to a press release from Geneseo Police Chief Eric Osganian, Brendon Kelly, 23, was arrested for Rape in the Third Degree, an E felony, on Nov. 25.
“This was a follow up on our arrest from the 15th,” said Chief Osganian. “The allegations are that he gave her alcohol and engaged in sexual conduct, and she was underage for both.”
Kelly is also facing charges of Unlawful Dealing with a Child and Endangering the Welfare of a Child, both A misdemeanors.
An order of protection was signed in favor of the alleged victim.
Kelly is not a student at SUNY Geneseo.
On both arrests, Kelly was arraigned before Geneseo Justice Thomas Bushnell and released on his own recognizance, or with no bail set.
Kelly will return to Geneseo Village Court to answer all of the charges at a later date.
