LIVINGSTON COUNTY – Two more suspects have pled guilty to felonies in connection the brutal beating and robbery of an Avon man of cash owed for an illegal marijuana sale.
Courtney Ortiz, 21, of Caledonia, pled guilty to felony Attempted Robbery in the Second Degree. Josue Quinones, 24, of Rochester, pled guilty to felony Robbery in the Second Degree. Judge Robert Wiggins said that he would allow both of them to remain out of custody until sentencing.
“It is indeed unusual for me to allow you to go free now that you have pled guilty to a violent felony,” said Judge Wiggins to Quinones. “However, as per our discussion in chambers, I will do so.”
Ortiz and Quinones are both represented by attorney Raymond Sciarrino. The Livingston County District Attorney’s Office has maintained since they both hired Sciarrino that this arrangement represents an irreconcilable conflict.
Benjamin Brown, 23, of Rochester, was the first of the suspects to plead guilty in connection to the incident on July 30, 2015, where the victim, a friend of Ortiz, was located by she and multiple cohorts including Brown and Quinones. They offered the victim a ride to Scottsville but turned down Lacey Road in Caledonia, where Quinones beat him and took cash from him.
Kyle Coley Adams, 24, is the one remaining suspect who is still presumed innocent. He and his attorney, Livingston County Assistant Public Defender Christopher Laragy, have requested that Judge Robert Wiggins review the minutes from Grand Jury proceedings for testimony or information that may help dispose of the case.
Brown testified implicating all other suspects arrested in connection to this incident. He pled guilty to felony Attempted Robbery in the Second Degree and agreed to serve a sentence of 2 years in state prison and 3 years on parole.
Ortiz agreed to serve 2 years in prison and 3 years on parole.
Quinones agreed to serve 7 years in prison and 5 years on parole.
Brown, Ortiz, and Quinones will return to Livingston County Court at a later date for sentencing.
