LIVINGSTON COUNTY – Two more sex offenders have been arrested by the Sheriff’s Office this week following sharp work by Sheriff’s investigator Dan Rittenhouse, including one who was already in jail on a parole violation for his sex crime with a child. Allegedly, the two men had Facebook accounts that they did not register with the Sheriff’s Office, a violation of the Sex Offender Registration Act (SORA).
According to a press release from Livingston County Sheriff Thomas Dougherty, Alan Spencer, 28, from Sparta and James Learn, 23, from Nunda, were arrested for Failure to Register and to Verify, a felony, for violating the New York State Sex Offender Registry Act.
Spencer was arrested on Wednesday, November 12 and Learn on Thursday, November 13, from the Livingston County jail, where he was being held on Violation of Parole charges. According to the NYS Department of Corrections, Learn was on parole since August 2012 for Attempted Use of a Child in a Sex Act, a D Felony. He served more than a year in Gowanda state prison, and was released on parole in August.
Spencer was taken into Oneida state prison in February 2007 for Rape in the Second Degree, also a D Felony, and released in July 2009 on parole.
Sheriff Dougherty added that per the provisions of the New York State Sex Offender Registry Act, any sex offender must register with the Sheriff’s Office no later than ten calendar days after any change of address, internet accounts, or internet identifiers are established. It is alleged that Spencer and Learn did have Facebook accounts that were not registered with the Sheriff’s Office.
Spencer was arraigned in the Town of Geneseo Court before Judge Houston and he was remanded back to the custody of the Sheriff on $2,500 cash bail or $5,000 bond, and is currently being held in the Livingston County Jail. Learn is set to answer charges in the Village of Geneseo court at a later date.
The investigations and arrests were handled by Investigator Dan Rittenhouse, who has spearheaded an extremely successful year in arresting sex offenders for violating SORA.
On Thursday, Robert Loveland, 33, of Springwater, was also arrested for Failure to Register and Verify due to an illegal Facebook account.
