AVON— The energy corporation Lenape Resources has taken the next step in their fight against local moratoriums by filing a lawsuit against the Town of Avon and the Department of Environmental Conservation.

Town Supervisor David LeFeber confirmed the town received the papers regarding the lawsuit on Tuesday, November 27, and will soon be in a court case defending the local law postponing any natural gas exploration within the town.
It was also confirmed that the Lenape gas wells within the town of Avon which were shuttered following the passing of the moratorium last June have been re-opened and are in operation.
Although Avon is not the only town in the area to postpone gas exploration with a local law, LeFeber stated he does not believe any other town has been served papers by Lenape.
The lawsuit will be a serious topic of discussion for the town board, however LeFeber said he could not guarantee they will be discussing it in open session, because it is litigation.
