The Sheriff’s office received a report of erratic driving at Interstate 390 in the Town of North Dansville on March 18th. Upon locating the suspect vehicle, the officer believed that the driver was operating under the influence of drugs. Evidence of drug use was also discovered in the vehicle.
Deputy Michael Donals of the Sheriff’s Office STOP DWI Unit responded to the scene to conduct a roadside DWAI investigation which included the performance of standardized field sobriety tests. At the conclusion of the roadside investigation, the was taken into custody for DWAI. Furthermore a records check revealed that the driver was operating the vehicle with his license suspended or revoked ten times.
The operator of the vehicle was identified as 39-year-old Stephen J. Zambito of Rochester.
Zambito was then transported to the Sheriff’s Office substation in Lakeville where Deputy Jeff Faugh, who is a Certified Drug Recognition Expert (DRE), conducted an evaluation. It was the Deputy Sheriff’s expert opinion that Zambito was under the influence of a narcotic analgesic and could not operate a vehicle in a safe manner. A urine sample was also collected and willbe sent to a forensic lab for analysis.
Zambito was arrested and charged with felony Aggravated Unlicensed Operation Zambito was arrested and charged with felony Aggravated Unlicensed Operation of a Motor Vehicle in the 1st Degree and Driving While Ability Impaired by Drugs.
Zambito was turned over to Central Booking Deputies at the Livingston County Jail for processing and issued appearance for the charges as the offenses did not qualify for pre-arraignment detention or for bail to be set under the NYS Criminal Justice Reform Act.
Zambito is scheduled to answer to the charges later in the Town of North Dansville Court.
