AVON – Sheriff Thomas J. Dougherty reports the arrest of an Avon, NY man on drug related charges after a traffic stop.
On December 29, 2018 Deputy Michael Phillips was assigned to the STOP DWI Unit when he stopped a vehicle on Avon-East Avon Road (Route 5) in the Town of Avon for a violation of the NYS Vehicle and Traffic Law.
The operator of the vehicle was identified as 35 year old Blake B. Borsching. During the course of the traffic stop, the Deputy Sheriff could smell the odor of marijuana emanating from the vehicle and also suspected that Borsching was under the influence of drugs. The Deputy
Sheriff conducted a DWAI investigation which included the performance of standardized field sobriety tests. At the conclusion of the roadside investigation, Borsching was taken into custody for DWAI Drugs. The Deputy Sheriff also discovered that Borsching was in
possession of marijuana, as well as concentrated liquid cannabis.
Borsching was then transported to the Sheriff’s Office Headquarters in Geneseo where Sergeant James Merrick, who is a Certified Drug Recognition Expert (DRE), conducted an evaluation on Borsching. It was the Sergeant’s expert opinion that Borsching was under the
influence of a narcotic and cannabis and could not operate a vehicle in a safe manner. Borsching also provided a urine sample which will be sent to the lab for analysis.
Borsching was charged with Driving While Ability Impaired by Drugs, Driving While Ability Impaired by a Combination of Drugs, Criminal Possession of a Controlled Substance in the 7th Degree, and Unlawful Possession of Marijuana. Borsching was then turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention. Borsching was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Geneseo Justice Kathleen Houston. The Judge released Borsching on his own recognizance (ROR).
