AVON — Charles Sutton III, 24, was sentenced Tuesday morning in the Livingston County Courthouse for stealing cash from the counter at Dutch Hollow and punching a clerk who chased him from the store.

Sutton previously pleaded guilty to grabbing money from the counter and attacking the clerk when they chased him down and grabbed some of the cash from his hand. Sutton said that he then jumped into a getaway car in the parking lot, driven by an accomplice. Sutton is known to have “substance abuse problems,” as his public defender, Marcea Tetamore, put it.
In the agreed upon sentence, Sutton will spend six months in Livingston County Jail and five years on probation, on the condition that he successfully completes the Treatment Court process. He will be required to appear in Treatment Court daily, and he will be regularly screened and tested for any trace of controlled substances.
However, if he fails to stay completely clean of illegal drugs, he will face 2 1/3 to 7 years in State prison. He is currently held at Livingston County Jail on $10,000 bail or $20,000 bond.
