NYLON – The Perry man whom a Livingston County Jury convicted of kidnapping has pled guilty to another felony charge against the same victim in Wyoming County.
Charles Braun, 67, pled guilty to felony Attempted Rape in the First Degree in full satisfaction of his five charges.
“The plea offer was originally made in March and has remained open, even at this late date, in an effort to avoid putting the victim through the stress and strain of another trial,” said Assistant Wyoming County District Attorney Eric Shiener, who prosecuted the case.
In November 2015, a Livingston County Jury found him guilty of felony Kidnapping in the Second Degree, felony Criminal Contempt in the First Degree, and misdemeanor Menacing in the Second Degree.
The victim testified at the Livingston County trial that Braun came out from under her porch in York with a small black handgun and forced her to drive in her car to his apartment in Perry. Police recovered smears of mud on her steering console, a hat that Braun admits was his under her porch, and packaging for a plastic BB gun pistol at Braun’s apartment.
Livingston County Judge Dennis Cohen sentenced Braun to 15 years plus 5 years of post-release supervision after that trial.
Shiener said that Braun sexually assaulted the victim at the Perry apartment and held her there against her will.
Schiener added that the promised sentence in Wyoming County will be 15 years and 5 years post-release supervision, to run concurrently, or at the same time as, the sentence from Livingston County. Braun is ultimately sentenced to serve 15 years in prison and 5 years on parole.
Upon his release, Braun will be a registered sex offender due to his Wyoming County sex offense.
The Wyoming County District Attorney’s Office would like to commend the hard work and collaborative efforts of the Perry Police Department, Wyoming County Sheriff’s Office and Livingston County Sheriff’s Office that resulted in the apprehension and successful prosecution of the defendant.
