MOUNT MORRIS: Sheriff Thomas J. Dougherty reports the arrest of a Mount Morris, NY man after Sheriff’s Deputies investigated a single car motor vehicle crash.
On July 18, 2018 at approximately 6:30 pm Sheriff’s Deputies were dispatched to Creek Road in the Town of Mount Morris for a roll over crash. The Deputy Sheriffs arrived on scene and the preliminary investigation revealed that the vehicle had been traveling southbound on Creek Road and failed to negotiate a curve causing the vehicle to leave the roadway, roll
over, and end up in a field.
The driver and sole occupant of the vehicle was identified as 46 year old Lewis E. Henry Jr. Henry did sustain injuries from the crash and was transported by EMS to Strong Hospital for treatment of his injuries. Investigating Deputy Sheriffs suspected that Henry was under the influence of alcohol. Deputy Shawn Whitford responded to the hospital to conduct a DWI investigation, which included obtaining a blood sample. The blood sample was sent to the lab for processing. The lab results revealed and allege that Henry’s blood alcohol content (BAC) was .26%.
On November 13, 2018 Deputy Whitford arrested and charged Henry with Aggravated Driving While Intoxicated with a BAC greater that .18%, and Driving While Intoxicated. The DWI charges are felonies as Henry has a previous DWI conviction in 2014. Henry was turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention. The District Attorney’s Office was contacted in regards to bail due to the felony charges and it was recommended that the Judge hold Henry on $2,500 cash or $5,000 bond.
Henry was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Caledonia Justice Mark Riggi. The Judge
remanded Henry to the custody of the Sheriff on $1,500 cash or $3,000 bond. Also investigating the incident for the Sheriff’s Office were Captain Norm Zeh and Deputy Robert Holt of the Forensic Identification Unit.
