An accident which occurred on November 28, 2020 that resulted in the death of Brian Hitchcock, 43, of Liverpool, NY, has resulted in June 2, 2023 manslaughter charges against his brother, a Livonia resident. The manslaughter charge is a Class C felony.

According to State Police, the 2017 Chevrolet pickup truck in which Brian Hitchcock was riding exited highway 70 and ran into a ditch and flipped in the town of Grove in Allegany County, while the pair was on their way to their father’s hunting camp. Brian Hitchcock was pronounced dead at the scene, and the driver, Brian’s brothe, Bill Hitchcock Jr. of Livonia, was also seriously injured with damage to his spine, as well as other injuries, and was taken to Noyes Memorial Hospital, and then transferred to Strong Memorial Hospital. Troopers suspected that Hitchcock’s blood alcohol level might be elevated, so while being treated in the hospital, a blood alcohol test was run showing his blood alcohol content was over .18%.
Based on the arrest report from the NYS Police, Hitchcock, 48. was released on his own recognizance for a future court date.
