According to a press release from Mount Morris Police Chief Ken Mignemi, John J. Fleming, 19, has been arrested and charged for sex offenses against a minor.
The allegations came to light after a family friend of the victim alerted Mt. Morris Police to the sex crime on Sunday, and a thorough investigation by Officers Rusty Tallion and Katelyn Sanders suggested that Fleming did have sex with the 12-year-old girl.
On Tuesday, Fleming allegedly admitted in an interview with Mt. Morris Police Chief Ken Mignemi that on two separate occasions, he had sexual encounters with the 12-year-old in Mt. Morris.
“His version of the story is that all of his actions were consensual,” said Chief Mignemi, “but we’re not going to assume that to be true.”
Fleming was charged before Judge James LaPiana with Criminal Sex Act in the 1st degree, a class B felony. Fleming was then remanded to the Livingston County Jail with $50,000 cash bail, $100,000 bond.
Flemming has similar charges pending in the Mt. Morris village court.
