On Tuesday, Feb. 28, at approximately noon, Santiago attacked both deputies, with one deputy sustaining head, wrist, and leg injuries. A second Deputy sustained injuries to his stomach and back.
Investigator James Merrick arrested and charged Santiago with two counts of Felony Assault in the second degree. The charges were the result of the injuries sustained by the deputies, and also the fact that the assault took place inside a correctional facility.
Santiago was turned over to central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention since the offenses did qualify for pre-arraignment detention under the NYS Justice Reform Act. Santiago was taken before Town of Lima Justice Schwing, who set the bail at $5,000 cash/credit or $10,000 bond.
The Livingston County Public Defender’s office was present and represented Santiago, and although the district attorney’s office was notified, they did not appear to represent the People.
The investigation was handled by members of the Criminal Investigations Division and the Jail Division.
