The Livingston County Drug Task Force reports the arrest of a Geneseo resident on multiple felony charges following an investigation into cocaine sales in the Village of Geneseo.
On March 22nd, 2023 members of the Livingston County Drug Task Force, Livingston County Sheriff’s Office, and the Geneseo Police Department executed a search warrant on Meadow Drive in the Village of Geneseo. Seized during the execution of the warrant was powder cocaine and prescription pills.
Jose D. Silva-Irizarry, age 43 from Geneseo NY, was arrested by members of the Livingston County Sheriff’s Office and the Geneseo Police Department. Silva-Irizarry was charged with one count of Criminal Possession of a Controlled Substance in the Third Degree (class B Felony), one count of Criminal Possession of a Controlled Substance in the Fourth Degree (class C Felony), one count of Criminal Possession of a Controlled Substance in the Fifth Degree (class D Felony), one count of Criminal Nuisance in the First Degree (class E Felony), one count of Criminal Possession of a Controlled Substance in the Seventh Degree (class A Misdemeanor) and two counts of Criminally Using Drug Paraphernalia in the Second Degree (class A Misdemeanor).
Silva-Irizarry was turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention. The offenses did qualify for pre-arraignment detention under the NYS Justice Reform Act; however, a Judge may not set bail and the individual must be released per the law.
Silva-Irizarry was arraigned by Town of North Dansville Judge Werth and was released on his own recognizance per the law. Silva-Irizarry is scheduled to appear in the Village of Geneseo court at a later date for additional proceedings.
The Livingston County Public Defender’s Office was present and represented Silva-Irizarry at the court arraignment for his defense. The Livingston County District Attorney’s Office was notified but did not appear to represent the People.
The Livingston County Sheriff’s Forensic Identification Unit (FIU) assisted with the investigation.
The Livingston County Drug Task Force is comprised of members of the following agencies, the Livingston County Sheriff’s Office, the Avon Police Department, the Caledonia Police Department, the Geneseo Police Department, the Dansville Police Department, the Mount Morris Police Department, the Nunda Police Department, the State University of Police at Geneseo, and the Livingston County District Attorney’s Office.
