Sheriff Thomas J. Dougherty reports the arrest of a Lima resident on felony weapon charges following an investigation by the Sheriff’s Office.
On May 26th 2023, at about 8:00 pm, Livingston County Sheriff’s Deputies responded to an address in the Village of Geneseo to speak with an individual about a separate incident that occurred earlier in the day in the Village of Lima. During the investigation it was discovered that, 39 year old Jose E. Rivero of Lima was involved in an argument with a family member. During the argument, Rivero allegedly brandished a handgun and threatened to kill the victim. Members of the Patrol Division with the assistance of the Criminal Investigations Division later obtained a search warrant in regards to the investigation. That search warrant was later executed at Rivero’s home, where he was found to be in possession of a loaded handgun which he did not have a license to possess.
Deputies then continued their investigation, and learned that the handgun was reported stolen out of Jacksonville Florida in 2014.
Rivero was arrested and charged with felony Criminal Possession of a Weapon in the Second Degree, felony Criminal Possession of a Firearm, felony Criminal Possession of Stolen Property in the Fourth Degree, Menacing in the Second Degree, and Harassment in the Second Degree.
Rivero was transported and turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-
arraignment detention. The District Attorney’s Office was contacted in regards to bail due to the felony level charges, who recommended he be held on $10,000 cash or $50,000 bond.
Rivero was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail
before Justice Werth. The Judge did order that Rivero be held on $2,000 cash or credit, or $5,000 partially secured bond.
The Livingston County Public Defender’s Office was present and represented Rivero at the court arraignment for his
defense. The Livingston County District Attorney’s Office was notified but did not appear to represent the people.
