On October 1, 2018 at approximately 8:55 pm, Deputies were dispatched to Chandler Road in
the Town of York for a single car motor vehicle crash. Upon arrival, Deputies located the
vehicle in question but discovered that the operator of the vehicle had fled the scene. A witness advised that the driver was the sole occupant and had left on foot. Sergeant Joseph Zambito and Deputy Jason Butterbrodt were able to locate the driver of the vehicle at a residence on Kingston Road in the Town of Leicester. The driver of the vehicle was identified as 36 year old Nick J. Williams. The Deputy Sheriffs further suspected Williams of being under the influence of alcohol.
Deputy Michael Phillips, who is assigned to the Sheriff’s Office STOP DWI Unit, was requested to the scene to conduct a DWI investigation which included standardized field sobriety tests. Following the DWI investigation, Williams was taken into custody for Driving While Intoxicated.
Williams was transported to the Livingston County Jail where Deputy Kenneth Hall of the
Sheriff’s Office Jail Division administered a breathalyzer test. The test showed that Williams
blood alcohol content (BAC) was .25%.
Williams was charged with Driving While Intoxicated, Aggravated Driving While Intoxicated
with a BAC greater than .18%, and Aggravated Unlicensed Operation of a Motor Vehicle in
the 1st degree. These charges are all felonies as Williams had a previous DWI related
conviction within the last 10 years and also had his driving privileges revoked for the DWI
related offense. Williams was also charged with Leaving the Scene of a Property Damage Collision and other violations of the Vehicle and Traffic Law.
Williams was turned over to Central Booking Deputies at the Livingston County Jail for
processing and pre-arraignment detention. The District Attorney’s Office was contacted in
regards to bail due to the felony level charges and they recommended that the Judge hold
Williams on $2,500 cash bail or $5,000 bond. Williams was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP)at the Livingston County Jail before Town of Leicester Judge Henry Smith. The Judge released Williams on his own recognizance and Deputies set him free.
