AVON: Sheriff Thomas J. Dougherty reports the arrest of an Avon NY man on felony charges after a traffic stop. On March 7, 2019 at approximately 8:00 pm, Deputy Connor Sanford was assigned to the Sheriff’s Office STOP DWI Unit when he stopped a vehicle on East Main Street in the Village of Avon for a violation of the NYS Vehicle and Traffic Law.
The operator of the vehicle was identified as 53 year old Darrin E. Graham. The Deputy Sheriff suspected that Graham was under the influence of both alcohol and drugs, prompting a roadside impaired driver investigation, which included the performance of standardized field sobriety tests. Following the roadside investigation, Graham was taken into custody for Driving While Ability Impaired. Graham was also found to be in possession of crack cocaine.
Graham was then transported to the Avon Village Police Department, where Officer Travis McFadden administered a breathalyzer test, resulting in a .07% BAC. Graham was then transported to the Sheriff’s Office Headquarters in Geneseo where Sheriff’s Sergeant James Merrick, who is a Certified Drug Recognition Expert, conducted a drug evaluation. It was the expert opinion of the Sergeant that Graham was under the influence of a CNS Stimulant and alcohol and could not operate a vehicle safely. A records check also revealed that Graham had a previous DWI related conviction within the last ten years, making this arrest a felony. Graham did consent to a urine sample and it will be sent to the lab for testing.
Graham was arrested and charged with Driving While Intoxicated, Driving While Ability Impaired, felony Driving While Ability Impaired by a Combination of Drugs and Alcohol, and Criminal Possession of a Controlled Substance in the 7th Degree. The District Attorney’s Office was contacted in regards to bail due to the felony level charge and they recommended bail at $5,000 cash or $10,000 bond.
Graham was turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention.
Graham was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Groveland Justice Jeanean Love. The Judge remanded Graham to the custody of the Sheriff on the recommended bail of $5,000 cash or
$10,000 bond.
