LAKEVILLE – Sheriff Thomas J. Dougherty reports the arrest of a Lakeville NY man on felony Driving While Intoxicated charges after Sheriff’s Deputies investigated a single car motor vehicle crash. On November 23, 2018 at approximately 11:28 am, Sheriff’s Deputies responded to Lakeville – Groveland Road for a single car motor vehicle crash. The preliminary investigation revealed that the vehicle was being driven by 49 year old Michael A. Walton, who was traveling southbound on Lakeville – Groveland Road when he lost control on a curve causing the vehicle to leave the roadway, roll over, and strike a utility pole.
Investigating Deputies suspected that Walton was under the influence of alcohol and a DWI investigation was started. At the conclusion of the roadside investigation, Walton was taken into custody for DWI. Walton was arrested and charged with Driving While Intoxicated and Speed Not Reasonable and Prudent for Conditions. The DWI charge was a felony due to Walton having a previous DWI related conviction in 2015.
Walton was then turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention. The District Attorney’s Office was contacted in
regards to bail due to the felony level charge and it was advised that the Judge hold Walton without the chance of bail due to having multiple prior felony convictions per the NYS Criminal Procedure Law. Walton was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of York Justice Daniel Koch. The Judge remanded Walton to the custody of the Sheriff without the chance of bail and Walton will remain at the Livingston County Jail for further proceedings.
