LIVINGSTON COUNTY – A Lima man is behind bars after a long legal process and September bench trial, in which he was found guilty of Falsifying Business Records in the First Degree, an E felony, though he has vehemently maintained his innocence throughout the process.
Krebbecks, 44, of Lima, claimed that his ATM card had been stolen and used to make several illegal withdrawals, but lost at trial against Assistant District Attorney Justin Hill when video surveillance from the ATM emerged showing Krebbecks himself making the cash withdrawals.
“Mr. Krebbecks maintains his innocence despite overwhelming evidence against him,” said District Attorney Greg McCaffrey. “I think six months’ straight time would send a message to Mr. Krebbecks, that the laws of this state need to be obeyed.”
Krebbecks’ sentencing was delayed by his attorney’s inquiries into his mental health status.
The judge indicated that there was some concern whether Krebbecks would continue with probation or mental health treatment programs, as on previous occasions, Krebbecks indicated to the probation department and the court that he wanted to continue using drugs and alcohol.
Krebbecks was finally sentenced to four months’ straight incarceration, with work release eligibility.
