LIVINGSTON COUNTY – A wild case that went to trial in September is still unresolved due to inquiries into the mental health of a local man by his attorney.
Mark Krebbecks, 44, originally claimed that his ATM card had been stolen and used to make several illegal withdrawals, but lost at trial against Assistant District Attorney Justin Hill when video surveillance from the ATM emerged showing Krebbecks himself making the cash withdrawals.
Krebbecks was convicted of Falsifying Business Records, an E felony, Filing a False Written Statement, an A Misdemeanor, and Falsely Reporting an Incident, an A Misdemeanor. He was scheduled for sentencing on Tuesday, but an inquiry into his mental health by his attorney is delaying the sentence.
Hill said that although Krebbecks did testify at trial that the bank had the dates of the transaction wrong and therefore the video surveillance didn’t prove anything against him, this doesn’t mean that he was lying under oath. He could still plausibly believe the bank’s dates to be wrong.
Hill is recommending that Krebbecks spend nine months straight incarceration in the Livingston County Jail for his crimes.
Time will tell how the of the mental health reports will affect Judge Wiggins’ sentencing decision.
