On December 14, 2018 at about 2:10 p.m. Sheriff’s Deputies assigned to the Livingston County Jail were alerted to the smell of tobacco smoke coming from the area of a cell in A pod. Deputy Laszlo Babocsi and Deputy Matthew Romanowski responded and investigated.
Deputies did confirm that the smoke was coming from a cell and removed the inmate. When doing so a small baggie that was concealed on the inmate’s person fell to the floor. The baggie contained tobacco. A search of the inmate revealed an additional nine (9) small baggies of tobacco.
The alleged inmate that possessed the contraband was identified as 37 year old Shahid M. Smith, who was being held after being sentenced to one (1) year for a conviction of Criminal Possession of a Controlled Substance charge. The investigation continued with Corporal Joshua Daly, Deputy Laszlo Babocsi, Deputy Matthew Romanowski, Deputy Jim Bennett and Deputy Jesse Galvin, all of the Sheriff’s Office Jail Division, handling. Corporal Daly arrested Smith on the two charges of Promoting Prison Contraband in the 2nd Degree and Tampering With Physical Evidence. Smith was transferred to the booking area of the jail to be processed and arraigned. The District Attorney’s Office was contacted in regards to bail due to the felony level charge and it was advised that the Judge hold Smith without bail set due to previous felony convictions per the NYS Criminal Procedure Law.
Smith was later arraigned at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Groveland Justice Jenean Love. The Judge remanded Smith back to the custody of the Sheriff without the chance of bail.
