LIVINGSTON COUNTY – A local resident was arraigned on another assault on Tuesday after allegedly knocking a teenage girl unconscious during an altercation.
Nicholas Fleck, 36, is now charged with Assault in the Second Degree, a D felony, and Aggravated Criminal Contempt, a D felony, after allegedly grabbing a 16-year-old by her clothing and striking their head against pavement.
“Mr. Fleck grabbed a 16 year-old by her hoodie and knocked her head on the pavement, knocking her unconscious,” said Assistant District Attorney Justin Hill. “He is also facing a pending Assault 3rd and Endangering charge out of Dansville. On those charges, bail is set at $15,000 cash or $30,000 bond.”
Fleck’s attorney, Heidi Feinberg, made a bail application on Fleck’s behalf at his arraignment on the new charges.
“Mr. Fleck has substantial ties to the area, he’s not a flight risk, he has a very loving 3 year old daughter,” said Feinberg. “The only reason he is not employed is as a result of his being incarcerated since June.”
Judge Robert Wiggins decreased bail on the new charges to $10,000 cash or $20,000 bond.
A complete stayaway order of protection was issued for the victim.
A non offensive contact order of protection was issued for Fleck’s girlfriend, the alleged victim of the previous Assault charge out of Dansville Town court.
