LIVINGSTON COUNTY — A married Chili man has been sentenced to 3 months of intermittent incarceration after pleading guilty to attempted rape of a minor, a class E Felony in court on Tuesday.
In court Assistant District Attorney Justin Hill stated that at night Jason Fritsch, 37, would drive his work truck to the 15-year-old victim, who lived in Nunda, and they would have sex.
“As an Assistant District Attorney and a father this chills my spine,” said Hill. “The only reason for this sentence is to spare the victim of having to come and testify during a trial.”
Hill continued to state his disgust of the defendant after he cited a court report that stated that Fritsch, who stood silently dressed in black and wearing his wedding band, blamed the victim for the rape taking place.
“Sometimes good people make mistakes,” said Defense Attorney James Philippone, “There is no miscarriage of justice here.”
Fritsch will also serve 10 years of probation, pay $1,400 in fines and be required to register as a sex offender.
