LIVINGSTON COUNTY — Frederick Symonds, Jr., 45, was sentenced in Livingston County Court on Tuesday to four years in state prison, to be followed by 10 years probation. Symonds was found guilty by a jury in December of criminal sex act in the 3rd degree, a class E felony; sexual misconduct; and incest. The sentence was based on the top charge, the criminal sex act, which carries a fixed sentence of a minimum of four years. Symonds was charged in a complicated family case that involved another family member, Matthew Symonds, 41, and the same victim. The now 18-year old victim, who testified dramatically during the trial, was 16 at the time of the offenses.
Symonds, represented by Public Defender Marcia Clark Tetamore, continued to assert his innocence prior to actual sentencing. District Attorney Greg McCaffrey asked for the maximum sentence, and described Symonds as “a sexual predator, a narcissist, and a liar. He preyed on a young girl who had already been raped, and he flat-out lied to the jury. He has accepted no responsibility for his actions whatsoever. We think the maximum possible sentence is appropriate.”
Confirming information that came up in Symponds’ pre-sentencing investigation report, which was discussed in court Tuesday, McCaffrey said that Symonds is also a suspect in another rape case downstate, in the Long Island area. McCaffrey told the GeneseeSun.com that the downstate case also appears to involve family members.
