LIVINGSTON COUNTY – Thursday marked the third day of a jury trial that could potentially put John Fleming, 19, in prison for life for Predatory Sexual Assault Against a Child.
However, given Fleming’s surprising testimony, in which he says he lied to police in his explicit confession to repeated sexual contact with a 12-year-old child, District Attorney Greg McCaffrey, the defense, Marcea Clark Tetamore, head of the Public Defender’s Office, and Judge Robert Wiggins are currently discussing whether the top charge is appropriate.
Fleming said that he lied to his interviewers and signed a written confession because he was nervous, and thought that if he told the police they would let him go home.
