LIVINGSTON COUNTY – A Mount Morris man is facing felony charges for allegedly possessing child pornography.
Kyle Kibler, 20, is charged with felony Possessing an Obscene Sexual Performance by a Child and felony Possessing a Sexual Performance by a Child.
“We’ll be entering a plea of not guilty at this point,” said John Putney, Kibler’s defense attorney. “We’re asking for a brief adjournment so that the court can arrive at a well-informed disposition.”
Assistant District Attorney Joshua Tonra, who appeared Tuesday morning, said that the FBI assisted New York State Police with the investigation.
The investigation alleges that Kibler possessed child pornography in March of 2016.
State Police arrested Kibler and issued him an appearance ticket for Mount Morris Town Court. At arraignment in Mount Morris Town Court, he was released on his own recognizance, with no bail required.
Kibler requested that his case be sent to County Court by Superior Court Information, skipping Grand Jury review that might have charges thrown out or changed.
Tonra said that the offer by the District Attorney’s Office is a guilty plea to Possessing an Obscene Sexual Performance by a Child, four weekends in jail and registration as a sex offender.
He will return to Livingston County Court at a later date for further proceedings.
