LIVINGSTON COUNTY – The biological father of the now six-year-old victim of sex abuse at the hands of Pastor Alan Fox of Dansville is seeking to regain custody of the victim and her four brothers and sisters, the eldest of whom are now 14 and 16 years old.

Fox pled guilty to Attempted Sex Abuse in the First Degree, an E Felony, last Wednesday in a special-term court appearance and admitted to touching the victim’s private area while stargazing in June 2013, and making her touch his. Now the child’s father, represented by East Rochester attorney David Morabito, is fighting to regain custody of his five children.
“These kids really love their parents,” said the victim’s Great Aunt, who at this time will not be identified by the GeneseeSun.com due to the ongoing legal process. “The oldest two are now 14 and 16 and plan to return to their parents as soon as they get free from the system.”
Morabito says that the father has taken big steps towards becoming a good father for the five children, and that no matter what is brought up in court, the most important thing is to protect the rights of the children. The children were removed from their mother’s home after the two were divorced, and allegations of abuse arose against her boyfriend.
“No allegations of abuse have ever been brought up against my client,” said Morabito. “When it comes down to it, we need to make a decision that is best for the children.”
Morabito added that there will be a fact finding hearing in January, where the Department of Social Services’ (DSS) attorney will present evidence and testimony from witnesses to a county judge, and Morabito can challenge that evidence and cross-examine those witnesses.
“I will say that I am impressed with the DSS attorney,” said Morabito. “I think that she is a compassionate and ethical person.”
