LIVINGSTON COUNTY – The young man who robbed the Dutch Hollow Market convenience store in Avon is likely headed to state prison now that he has entered a guilty plea to a violation of his probation due to his possession of alcohol and heroin.

Charles Sutton III, 24, was sentenced in July to six months in local jail and five years’ probation after he said he stole cash from the store counter and punched the clerk who chased him to his getaway car, and now says that after his release from jail, he bought alcohol and heroin.
During court proceedings for his Robbery sentence in July, his public defender at the time, Marcea Tetamore, said that he is known to have “substance abuse” problems. Part of the negotiations over the terms of his release and probation was that Sutton was to complete Treatment Court and stay completely clean of drugs.
Sutton was explicitly warned in July that if he is caught with drugs or alcohol, he will face state prison time. District Attorney Greg McCaffrey’s Office is recommending that he be sentenced to two to six years in state prison, with eligibility for Shock camp.
Sutton said that he possessed the heroin with intent to give it to someone else.
He is currently held without bail in the Livingston County Jail and awaits sentencing in January.
