CONESUS – On October 17th, Anne Aguirre, 48, of Conesus was arrested following a vehicle stop and failed sobriety test in Livonia. At the time of arrest, Aguirre was driving with a child in her vehicle. She later took a breath test that registered at a BAC of .16.

Aguirre was charged under a New York State law called Leandra’s Law, which makes DWI charges an automatic felony if a child is in the vehicle, with the allowable BAC remaining at .08.
In addition to the Leandra’s Law charge, she was charged with a misdemeanor DWI, and Endangering the Welfare of a Child.
She was arraigned at Livingston County Jail before Avon Village Justice Temperato, and was released on her own recognizance.
