DANSVILLE – The driver of a pickup truck that crashed through an Ossian Street home and fatally injured 4-month-old Calin Fly as he lay in his baby swing is being indicted on Manslaughter charges by a Grand Jury after hearing evidence presented by Livingston County District Attorney Gregory McCaffrey.
Tracy Abbott, 51, of Dansville, was arrested and arraigned before Judge Dennis Cohen for Manslaughter in the Second Degree, a C felony, after DA McCaffrey presented the case to the Grand Jury.
Abbott is known to have a history of seizures.
The victim Calin Fly was also known to be battling pneumonia, and possibly be facing open-heart surgery before the deadly crash. A fundraising page, called ‘Calin’s Crusaders,’ was set up in the aftermath of the accident.
Calin was kept in guarded condition at Strong Memorial hospital for a few days following the September 29, 2014 accident, but sadly passed away on October 4.
Abbott was remanded to the Livingston County Jail on $5,000 cash or bond, and will be back in court on April 23 for further proceedings.
According to a press release from DA McCaffrey, the investigation was led by the Dansville Police Department, with assistance from the Livingston County Sheriff’s Department, the New York State Police, Livingston County DA McCaffrey, and numerous medical, fire and emergency personnel.
