GENESEO — Two cousins that were arrested after a routine traffic stop and charged with possession of Marijuana, Ecstasy and Cocaine have a chance at avoiding state prison if they make it through Willard treatment facility.

Robert and Joshua Smith, 21 and 23 years old, were pulled over for a traffic violation after cutting off a an oncoming car near exit 9 on Interstate 390 in Avon. The Sheriff’s deputy and K9 dog Utah, searched Robert’s car where the drugs were then discovered.
The two were charged with Criminal Possession of a Controlled Substance in the 3rd Degree, a Class B Felony and Criminal Possession of a Controlled Substance in the 7th Degree, a Class A Misdemeanor. Joshua E. Smith was also charged with Criminal Possession of Marihuana in the 5th Degree, a Class A Misdemeanor.
County Court Judge Dennis Cohen presided over the case and gave advice to Robert Smith,
“Our pre-plea investigation found that you have been smoking marihuana since you were 13 daily, and would use any drug you could get your hands on. This has affected your life in a severe way, and we hope that you are really ready to make changes,” said Cohen.
Both Smiths entered into a plea deal, pleading guilty to the charges and if they fail at Willard they face 4 years in state prison.
