CONESUS – The Town Board will hold a special meeting Wednesday night to decide whether to take their own planning board to court ‘with regard to a determination at the ZBA’s most recent meeting.

The Town Board meets Wednesday at 7:30 p.m. at their town hall, 6210 Rte. 15 (South Livonia Road) in Conesus.
A notice posted to the Town of Conesus website says that the Board will ‘consider whether the Conesus Town Board should move forward with filing an Article 78 Petition against the Conesus Zoning Board of Appeals with regard to a determination made on Monday, November 27, 2017 by the Zoning Board of Appeals and filed with the Town Clerk on November 29, 2017.’
An Article 78 Petition is, in simplified terms, to determine whether a particular government body or officer took some action illegally, without proper jurisdiction or outside of required procedure.
On Nov. 27, the ZBA had a meeting that was only a few minutes long. The only business handled was to formally close a public hearing set for the Myers Inn construction project, which they did.
The Town Board is currently involved in a high-profile Article 78 proceeding filed by the neighbors to the Myers Inn construction project.
