LIVINGSTON COUNTY – A Mount Morris man pled guilty to assault charges on Tuesday following an investigation into a domestic incident in which he apparently beat his own children with a plastic bat.
According to Livingston County District Attorney Greg McCaffrey, the charges against Duane Urbanik, 44, stemmed from allegations that he had attacked his two children with a plastic bat. The charges were reduced, however, from Assault in the Second Degree, a D felony, to Attempted Assault in the Second Degree, an E felony, in lieu of a plea.
County Judge Robert Wiggins said that although the Assault 2nd charges are reduced, it is still possible that more charges may arise from the same incident.
Part of the investigation included a review of a written statement Urbanik made to State Police.
Urbanik was quiet and extremely polite in court, answering all questions with “yes, Your Honor,” or “no, Your Honor.”
Urbanik was sentenced to 60 days’ incarceration at the Livingston County Jail, and his bail status of $3,000 cash or $6,000 bond was continued. Urbanik is currently still in the Jail.
