On September 26, 2018 Deputy Shawn Whitford was assigned to the Sheriff’s Office Operation Safe Interstate initiative when he stopped a vehicle on Lakeville Road in the Town of Livonia after previously observing a violation of the NYS vehicle and traffic law.
During the course of the traffic stop the Deputy Sheriff suspected that the occupants of the vehicle were involved with drug activity. Further investigation revealed that a passenger in the vehicle, 48 year old Ernest C. Hutton, was found to be in possession of crack cocaine, as well as a smoking device.
Hutton was arrested and charged with Criminal Possession of a Controlled Substance in the 7th Degree and Criminal Use of Drug Paraphernalia in the 2nd Degree.
Hutton was turned over to Central Booking Deputies at the Livingston County Jail for processing and pre-arraignment detention.
Hutton was later arraigned at the Livingston County Centralized Arraignment Part at the Livingston County Jail (LCCAP) before Town of Groveland Justice David Livingston. The Judge did remand Hutton to the custody of the Sheriff on $2,000 cash bail or $4,000 bond.
Assisting Deputy Whitford with the traffic stop was Deputy Jason Butterbrodt.
Livingston County Sheriff’s Investigators were also looking for Ernest Hutton in regards to the theft of a motor vehicle. The incident occurred on August 18, 2018 when Sheriff’s Deputies responded to the Hemlock Park on Rix Hill Road in the Town of Livonia for the report of a stolen 2008 Chevy Malibu. Sheriff’s Investigators quickly identified Hutton as the suspect in
the theft. On September 27, 2018 Deputy Mike Williams, who is assigned to the Sheriff’s Office Criminal Investigations Division, arrested and charged Hutton with felony Grand Larceny in the 3rd Degree.
Hutton was processed on the charge by Central Booking Deputies and held for prearraignment detention on the new charge. The District Attorney’s Office was contacted in regards to bail due to the felony level charge. It was advised that Hutton should be held without the chance of bail due to him having previous felony convictions.
Hutton was arraigned on the new charge of Grand Larceny at the Livingston County Centralized Arraignment Part (LC-CAP) at the Livingston County Jail before Town of Groveland Justice David Livingston. The Judge did remand Hutton to the custody of the Sheriff being held without the chance of bail; Hutton will be held until further court proceedings.
