LIVINGSTON COUNTY — A Nunda woman, arrested in March for DWI and operating a vehicle with a missing tire, made an additional appearance in front of Judge Robert B. Wiggins.
Roxanne Tallman, 57, appeared with her attorney, Kevin Van Allen, who put forth an application for bail on behalf of his client. According to Van Allen, Tallman’s current status, as a Livingston County Jail inmate, is prohibitive to her goal of receiving substance abuse treatment.
Judge Wiggins, however, stressed that “the trust of the court was violated”, referring to previous sobriety violations, and denied the defendant bail. According to ADA Josh Tonra, if the defendant is deemed treatment court eligible she is expected to receive a six-month sentence, plus five years of probation. If the defendant is not eligible, she will likely receive one-year, plus five years of probation.
The matter has been adjourned for a pre-plea investigation.
